Federal Judge Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The situation originates in a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her decision, the judge noted that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
